    for the record, at 4 :22 when i 1st watched this video, i already knew he had flaws in video.. #1, i already knew a constitution just meant owing a debt... and #2, at 4:22, he mentions the Declaration of Independence...I already knew by reading the PDF America is still a British Colony that the King Never left.. more important, the 1776 Declaration of Independence has a lower case ' u '... If you look at the authentic one... after going over a variety of the writing, eventually i noticed they reformatted the one they 1st created into a new one on computer writing and redid the 'u' and turned it into a ' U '.. looking into high schools history classes

      Doesn't have to be. If, as you claim, Title 42 was not enacted as positive law, it would be considered prima facie evidence that the law was enacted by the passing of an act of Congress. Which is why a list of the relevant public laws enacted by Congress appear at the bottom of each section of Chapter 7 in Title 42. Unless you can show that what is written in Title 42 is not an accurate representation of what was passed by Congress when arguing your case, you are going to lose that particular argument.

    My favorite is Bill of rights amendment V which is part of the constitution. Nor man be denied life, liberty, or property without due process of law. That is the strongest to stop them and add, Chisholm v Georgia. Makes it very clear

      @Charley Dan In what fantasy world would that be that you have clients? What proof do you have that you have clients, made successful motions, or have ever won a case? Unless you are a member of a state bar association, you cannot represent anyone in court but yourself unless a judge allows you to and that is highly unlikely. I'm not going to waste my time answering the silly questions you have posed. You were shown to be wrong in your statements regarding the three court cases you cited and are a purveyor of legal gibberish passed off as knowledge.

Name one or two motions you would make at beginning. Where do you put your motion on paper. Beginning or end of your body of reasoning? When filing, how does one establish and keep their court of record?

      Edward Longshanks I'm not c going to spend lots of time on this. You read case law, but do not comprehend the doctrine that goes with it. Remember, one has to know how the case is presented. Is it presented constitution compliant and ignored law or law compliant and constitution ignored. That is the first thing a judge looks at. The reason of the farmer case, Justice John Marshall statedis so important.. Most today is constutional compliant. I use law compliant and that is found in the Constitution Bill of Rights fifth amendment; referred to as due process clause. Understanding those two things, and looking how the case presented gives you doctrines of quite contrary opinion. No amendment changed the fifth due process clause. Also, referred to as the clause of inelienable rights. Constitution compliant is legislative, public law. Law compliant is individual law or common law due process. In brief, the due process clause is where your rights are. Not the second, seventh or under the fifth as attorneys and judges like to refer to. That is constutional compliant. Law compliant is due process clause.

      @Charley Dan Chisolm v. Georgia, 2 US 419 (1793), was about whether or not a citizen of a state could sue another state in federal court. The executor of the estate of Mr Chishom attempted to sue the state of Georgia for payments due Mr Chisolm for goods he had supplied to Georgia during the Revolutionary War. Georgia argued that it could not be sued without granting its consent to the suit because it was a sovereign state. The US Supreme Court disagreed and ruled Mr Chisolm's estate could sue Georgia. Two years later, in 1795, the 11th Amendment to the US Constitution was ratified. The 11th Amendment says a citizen of one state, or of a foreign country, can only sue another state with that state's consent. This effectively reversed Chisolm v. Georgia. I wouldn't get very excited about In Re Self v. Rhay, 61 Wn.2d 261 (1963). It was a decision regarding a petition for a writ of habeas corpus from Mr Rhay, who was arguing that his death sentence, imposed for committing murder in the first degree, was unconstitutional. He based this argument on the claim that the laws of Washington, as represented by the Revised Code of Washington, had not been properly amended in accordance with the applicable procedure in the Washington constitution. The court rejected the argument, ruling that the procedure to amend the laws as represented by the code had been properly followed, denying his petition for a writ of habeas corpus, and ordering that he be produced in the Superior Court for King County for setting the time of his execution. Nowhere in the decision does the court say anything like your claim that "common law is the real law" or that "codes, regulations, polices and statues are not real law". Statutes are laws enacted by a legislative assembly such as Congress or a state's house of representatives. A code is a systematically organized collection of the laws on a particular subject, such as a state's motor vehicle code or criminal code. Kent v. Dulles, 357 US 116 (1958), is a US Supreme Court decision about the denial of a passport to Mr Kent and to Mr Briehl because both refused to submit an affidavit regarding membership, past or present, in the Communist Party and both allegedly had "Communistic beliefs and associations" Yes, the Court ruled that a denial of a passport was a violation of their right to travel without due process and that the Secretary of State, Mr Dulles, did not yet have the authority to deny a passport on those grounds. What is did not due was hold that a passport could never be denied nor did it rule that a requirement to possess a passport was a violation of one's right to travel. This case is often and wrongly cited as supporting an argument that a requirement to possess a valid driver's licence when driving an automobile on public roads is a violation of one's right to travel. That particular argument has been consistently rejected by the courts. Pollock v. Farmers' Loan & Trust Company, 157 U.S. 429 (1895), was a US Supreme Court decision that struck down an income tax imposed by the Wilson-Gorman Tariff Act as being an unapportioned direct tax. Tax protesters sometimes point to this case as proof that a federal income tax is unconstitutional. However, the 16th Amendment was ratified in 1913 and this superseded the ruling in Pollock v. Farmers' Loan & Trust Company. Subsequent US Supreme Court and other federal court rulings have upheld the authority of Congress to levy income taxes without having to apportion them amongst the states. Those who have argued that the 16th Amendment was somehow invalid have had their arguments rejected.

Which suggests you should get a general usage dictionary and pay attention to the red wavy lines that appear under the words you type. Then you might have spelled the words "different" and "legalese" rather than "deferent" and "legalise". But apparently that was over your head. Do you call yourself "seoulkidd1" because you are of Korean descent, were actually born in Seoul, or just because you couldn't spell soul?

You would then know that "deferent" means showing great respect and that "legalise", or "legalize" as it is spelled in American English, means to make legal. As in Canada enacted legislation to legalise the possession of pot for personal use.

      How do you ejaculate yourself to the police? I don't think you really want to do that since that would most likely result in a charge of indecent exposure at the very least. LOL. There is no exemption for those not engaged in commerce provided to the law requiring you to possess a valid driver's licence. A state is NOT limited to only regulating commercial activity and the not engaged in commerce argument has been rejected by the courts.

      I have done this... and it is still viable Alan.. but no where near as easy as it used to be... you have to solidly establish and secure your own standing on the record, and then put the judge in a corner to limit his responses.... not something for the newbie at law without some major guidance. Although... if you were able to do it in front of a jury.... it would be a slam dunk !!

    A person could get the arresting officer on the witness stand and ask him if the constitution has been changed in recent years , of course he won’t know. That’s when you ask him or her to read the law he arrested you under, after he reads it you ask him to find it in the constitution. I think case dropped

      The US Constitution and state constitutions provide the foundation for the respective legislative assemblies to enact laws. The US Constitution and state constitutions were not meant to be an exhaustive list of every law allowed. That a particular law is not found in the applicable constitution is of no consequence. You might want to actually read the US Constitution and your state's constitution at some point.

      The right to assemble has nothing to do with the right to bear arms. You may also be required to obtain a permit to assemble if you were planning on exercising the right to assemble through the likes of holding a parade. The US Supreme Court has held that a state may require such a permit and to charge a reasonable fee for it. Cox v. New Hampshire, 312 U.S. 569 (1941), stated the "authority of a municipality to impose regulations in order to assure the safety and convenience of the people in the use of public highways has never been regarded as inconsistent with civil liberties, but rather as one of the means of safeguarding the good order upon which they ultimately depend" and "[i]n exercise of its power to license parades on city streets, the State may charge a license fee reasonably adjusted to the occasion, for meeting administrative and police expenses." What a municipality cannot do is refuse to issue you a permit for such an assembly for the express purpose of denying the right of freedom of expression rather than the legitimate purpose of regulating the streets and sidewalks for the safety and convenience of the general public - Shuttlesworth v. City of Birmingham, 394 U.S. 147 (1969).
